These Standard Terms and Conditions (“Terms”) govern all legal, taxation, documentation, drafting, or compliance-related services (“Services”) offered by LawBharat Associates, a legal and professional consultancy firm headquartered at Varanasi, India. By engaging our Services through our website or offline channels, you agree to be bound by the following Terms:
- Definitions
- "Client" means any individual, company, firm, or entity purchasing Services from LawBharat Associates.
- "Agreement" refers to these Terms and Conditions of Sale and any work order, invoice, or proposal executed between LawBharat Associates and the Client.
- "Services" include all legal drafting, representation, consultation, filing, taxation, and allied services offered by LawBharat Associates.
2. Acceptance of Terms
By accessing our website, making a payment, or submitting a service request form, you agree to be legally bound by these Terms, as updated from time to time in accordance with applicable laws, including:
- Bharatiya Nyaya Sanhita (BNS), 2023
- Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023
- Information Technology Act, 2000
- Indian Contract Act, 1872
3. Scope of Services
LawBharat Associates provides the following categories of services:
- Legal Drafting (Affidavits, Petitions, Contracts, Notices)
- Litigation Support & Representation (Civil/Criminal/Family/Consumer)
- Corporate & Tax Advisory (ITR, GST, ROC, CA services)
- Property & Real Estate Documentation
- POSH Act & Labour Law Compliance
- Company Incorporation & Startup Legal Services
- Legal Opinion, Consultancy & Policy Vetting
We reserve the right to refuse services where client requests violate the law, professional ethics, or internal conflict rules.
4. Fees and Payments
- All prices are inclusive of applicable professional fees, but exclusive of government filing fees, stamp duty, and taxes (GST @18%), unless otherwise mentioned.
- 100% advance may be required for certain filings, registrations, or court documentation.
- No refund shall be provided once the service has been initiated, except as outlined under our Refund & Cancellation Policy.
- Invoice will be generated electronically and sent via email or WhatsApp.
5. Delivery Timelines
- Standard delivery timelines vary between 24–72 working hours, depending on service complexity.
- Delays caused due to lack of client documentation, holidays, or jurisdictional delays (e.g. court, government departments) shall not be the liability of LawBharat Associates.
6. Client Responsibilities
Clients are required to:
- Provide complete, accurate, and updated information/documents
- Respond to communication in a timely manner
- Cooperate in verification and execution processes
- Ensure that requested services are not intended for unlawful purposes
7. Confidentiality
- All client information, documents, and discussions shall be kept strictly confidential in accordance with professional ethics and applicable privacy laws, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
8. Intellectual Property Rights
- All templates, drafts, legal formats, and documents created by LawBharat Associates remain its intellectual property unless otherwise agreed in writing. Unauthorized reproduction or commercial use is prohibited.
9. Limitation of Liability
LawBharat Associates shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of service use, including but not limited to:
- Court verdicts or government orders beyond our control
- Delay in third-party approvals (e.g. GSTN, ROC, Trademark Registry)
- Client misuse or misrepresentation of legal documents
10. Dispute Resolution
- Any dispute shall first be attempted to be resolved amicably through mediation.
- If unresolved, the matter shall be subject to exclusive jurisdiction of courts at Varanasi, Uttar Pradesh.
11. Force Majeure
- LawBharat Associates shall not be held liable for failure or delay in performance due to causes beyond its reasonable control, including but not limited to natural calamities, network outages, court closures, or regulatory restrictions.
12. Amendment and Updates
- These Terms may be updated periodically in compliance with regulatory developments or internal policy changes. Updated Terms will be posted on our website. Continued use of our services constitutes deemed acceptance of modified Terms.
